Eligibility for the UK Parent Visa

  • Your child must be under 18 at the date of application.
  • Your child must be living in the UK and be a British citizen, or have settled status (ILR).
  • You must have sole parental responsibility for the child, OR
  • You share parental responsibility with a person who is not the child's other parent (who must be a British/settled person).
  • You must be able to prove that you are taking an active role in the child's upbringing.
  • You must meet the English language requirement (A1 level).
  • You must be able to maintain and accommodate yourself without recourse to public funds.

Understanding 'Sole Responsibility'

Sole responsibility is a high legal threshold. It means that you alone have been responsible for making all the major decisions in the child's life (education, health, religion, etc.) to the exclusion of the other parent. If the other parent is still involved, you may need to apply under the 'Access' route instead. The 5-Year vs 10-Year Route

Common FAQ's for Parents

  • Can I apply if my child is over 18? Only if they were under 18 when you first got your visa and they have not started an independent life.
  • What if the other parent is in the UK? If the other parent is a British/settled person and you are not in a relationship with them, you can still apply as long as you have frequent access to the child.
  • How long does the visa last? Usually 2.5 years, after which you must apply for an extension.
  • Can I switch from a Visitor Visa? Generally, you cannot switch from a visitor visa to a parent visa from within the UK, but there are exceptional circumstances where this is possible under Human Rights grounds.
