It exists because of the Withdrawal Agreement between the UK and the EU, which protected the right of EU citizens living in the UK and their close family, to continue their lives here even after free movement ended. Rather than sitting under the standard Immigration Rules used for most family visas, applications are assessed under a separate set of rules known as Appendix EU (Family Permit).

The permit itself does not grant long term status. It simply gets you into the UK. Once here, you then need to apply to the EU Settlement Scheme itself to secure pre settled or settled status, which is where your actual long term right to remain comes from.

Who Can Sponsor You for an EUSS Family Permit?

Your sponsor needs to already hold or be eligible for, pre settled or settled status under the EU Settlement Scheme. In practice, this covers a specific set of people.

  • An EEA or Swiss citizen with pre settled or settled status, or someone who would be eligible for it if they applied
  • An eligible person of Northern Ireland, meaning someone with British or Irish citizenship, born in Northern Ireland, who meets certain family and residence conditions
  • A British citizen who also holds EEA or Swiss citizenship and previously lived in the UK using their EEA or Swiss rights before becoming British, sometimes referred to as a Lounes case
  • A small number of dual British and EEA or Swiss citizens who settled in the UK on or before 16 July 2012 without relying on free movement rights

What Rights Does an EUSS Family Permit Actually Give You?

Once granted, the permit lets you enter the UK and stay for up to 6 months, with full permission to work and study during that period.

You can also leave and re-enter the UK as many times as you like before the permit expires, which is useful if you need to travel back and forth while sorting out your longer term status. Without the permit, airlines and border officials may refuse to let you board or enter the UK at all, so it genuinely functions as your ticket in, not just paperwork.

What it does not do is grant permanent status on its own. That only comes once you separately apply to the EU Settlement Scheme, which you’re required to do within 3 months of arriving.

How is This Different From a Standard UK Family Visa?

Is the EEA Family Permit the Same Thing?

No, and this is one of the most common points of confusion online. The EEA family permit was a separate, older route that closed to new applications on 30 June 2021, and any existing permits stopped being valid from that date too.

If you come across older guidance still referring to the EEA family permit as something you can currently apply for, treat it as outdated. The EUSS family permit is the route that replaced it, and it’s the only one currently available for this type of application.
