British Citizenship
Overview
Becoming a British citizen is the final chapter of your immigration story. It grants you the right to hold a British passport, vote in all elections, and live in the UK permanently without any immigration control. Whether you are applying through naturalisation based on residency, marriage to a British citizen, or through registration for children born in the UK, the requirements are strict—particularly regarding 'good character' and residency. Westbury Law provides the expert oversight needed to ensure your application is successful the first time. At Westbury Law, we specialize in navigating the complexities of British Citizenship. Our team ensures that your application is thorough, accurate, and presented in the best possible light to the Home Office.

Routes to British Citizenship
- Naturalisation after 5 Years: The standard route for those who have held ILR for at least 12 months.
- Naturalisation through Marriage: For those married to a British citizen (requires 3 years residency and ILR).
- Registration for Children: For children born in the UK whose parents later gain settled status.
- Registration of Overseas Births: For children born abroad to at least one British parent.
- Statelessness & Windrush: Special registration routes for unique historical circumstances.
Critical Requirements
- Residency: You must not have been outside the UK for more than 450 days in the 5 years (or 270 days in 3 years) prior to applying.
- Final Year Absence: You must not have spent more than 90 days abroad in the 12 months before the application.
- Good Character: This includes criminal records, but also civil matters like bankruptcy, late tax returns, or previous immigration breaches.
- English & Life in the UK: You must have passed the Life in the UK test and meet the English B1 requirement.
- Intention to Reside: You must intend to make the UK your principal home.
The 'Good Character' Test
The Home Office places extreme weight on the Good Character requirement. Even minor issues like driving offences or historical overstaying can lead to a refusal. At Westbury Law, we help you proactively disclose and explain these issues using legal precedents to minimize their impact on your application.
